NOTICE OF FORECLOSURE
WHEREAS, IDEAL MURFREESBORO, LLC, a Wyoming limited liability company (the “Borrower”), made that certain Secured Note dated March 9, 2022 (the “Note”), in favor of AVATAR REIT I LLC, a Delaware limited liability company (hereinafter referred to as the “Lender”), in the original principal amount of Two Million Five Hundred Sixty-Two Thousand and No/100 Dollars ($2,562,000.00); and
WHEREAS, to secure the Note, Borrower conveyed certain real property to Fidelity National Title Insurance Company, as Trustee, by a Deed of Trust, Assignment of Leases and Rents, Fixture Filing, and Security Agreement dated March 9, 2022, and recorded on March 22, 2022, in Book 2222, Page 1711, in the Register’s Office for Rutherford County, Tennessee (the “Deed of Trust”); and
WHEREAS, by instrument titled Appointment of Substitute Trustee dated April 3, 2024, and recorded April 9, 2024, in Book 2426, Page 2696, in the Register’s Office for Rutherford County, Tennessee, Bradley H. Hodge was appointed by Lender as substitute trustee (the “Substitute Trustee”) under the Deed of Trust in the place and stead of Fidelity National Title Insurance Company; and
WHEREAS, Borrower is in default in the performance of the covenants, terms, and conditions of the Note, and Lender has declared the Note and all other indebtedness related thereto immediately due and payable.

This sale is subject to ad valorem taxes (whether delinquent, for the current year, or for subsequent years), any liens or encumbrances which have priority over the lien created by the Deed of Trust, and any statutory rights of redemption of any governmental entity or agency. The high bidder shall pay a non-refundable deposit on the day of the sale in the amount of 10% of the high bidder’s bid price and shall pay the balance of the sales price within ten (10) business days following the day of the sale. All such amounts shall be paid in cash or other immediately available funds in U.S. Dollars. Title to the above-described real property shall be transferred by a substitute trustee’s deed, AS IS and WHERE IS, with no representations or warranties of any nature.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Lender, be cause for rejection of the bid, and if the bid is rejected, the Lender shall have the option of making the sale to the next highest bidder who is able, capable, and willing to comply with the terms hereof. This matter came to be heard on the 15th day of February 2024, before the Honorable Barry Tatum, upon Motion of the Plaintiff, LOGAN CHASE acting as Owner of Phase B Electric, LLC., for an order permitting service by publication pursuant to T.C.A. 21-1-203 and T.C.A. 21-1-204, upon the Defendant STEVEN AUSTIN EVANS. Based upon the Motion, statement of counsel, and record in this matter, the Court finds the following:
1. Plaintiff filed a Civil Summons in this action on August 28, 2023. And summonses were issued for the Defendants at their last known addresses.
2. Unfortunately, the Rutherford County Sheriff’s Department was unable to serve the Defendant.
3. On December 5, 2023, Plaintiff filed and Alias Civil Summons and hired a private process server to serve Defendant.
4. The private process server has made numerous attempts at service and has spoken with the Defendant on multiple occasions. The Defendant is aware of the action and tells the process server he will meet them but intentionally fails to do so.
5. Plaintiff’s counsel has performed extensive searches utilizing its available person-locating software, and no results have been returned that have not yet been exhausted.
6.Service has been attempted at all known and discovered locations.
7. Plaintiff has no other way of contacting the Defendants or discovering their whereabouts for the purpose of service of process.
8. Therefore, Plaintiff has exhausted all means of locating the Defendants, and the Defendants current locations are unknown and cannot be ascertained upon diligent inquiry.
IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED that:
1. Process and service shall be made through publication by notice in a local newspaper in accordance with T.C.A. 21-1-203 and T.C.A. 21-1-204
2. The notice shall state the following: “This is notice to STEVEN AUSTIN EVANS, has filed a Civil Summons against you in a matter styled LOGAN CHASE acting as owner of Phase B Electric, LLLC. Vs Steven Austin Evans filed in General Sessions Court of Wilson County, Tennessee, located at 134 South College St. Lebanon, TN 37087, Case No. 2023-CV-2462. Failure to appear and respond to Civil Summons filed in this matter will result in the entry of default judgement against you”
3. Once publication has been made for four (4) consecutive weeks, an affidavit of proof of publication shall be filed with this Court;
4. Upon such proof the Court shall deem service of process accomplished in accordance with Tennessee Law and this matter shall proceed accordingly;

Proposed Flood Hazard Determinations for the City of Murfreesboro,
Rutherford County, Tennessee, Case No. 24-04-2722P. The Department of
Homeland Security’s Federal Emergency Management Agency (FEMA) solicits
technical information or comments on proposed flood hazard determinations for
the Flood Insurance Rate Map (FIRM), and where applicable, the Flood Insurance
Study (FIS) report for your community. These flood hazard determinations may
include the addition or modification of Base Flood Elevations, base flood depths,
Special Flood Hazard Area boundaries or zone designations, or the regulatory
floodway. The FIRM and, if applicable, the FIS report have been revised to reflect
these flood hazard determinations through issuance of a Letter of Map Revision
(LOMR), in accordance with Title 44, Part 65 of the Code of Federal Regulations.
These determinations are the basis for the floodplain management measures that
your community is required to adopt or show evidence of having in effect to qualify
or remain qualified for participation in the National Flood Insurance Program. For

not be granted. Pursuant to O.C.G.A. Section 15-11-284, Notice of Effect of
Termination Judgment:
If you fail to appear, the court can terminate your parental rights in your absence. If
the court at the trial finds that the facts set out in the petition to terminate parental
rights are true and that termination of your rights will serve the best interest of your
child, the court can enter a judgment ending your rights to your child.
If the judgment terminates your parental rights, you will no longer have any rights
to your child. This means that you will not have the right to visit, contact, or have
custody of your child or make any decisions affecting your child or your child’s
earnings or property. Your child will be legally freed to be adopted by someone
else.
Even if your parental rights are terminated: (1) You will be responsible for providing
financial support (child support payments) for your child’s care unless and until
your child is adopted; and (2) Your child can still inherit from you unless and until
your child is adopted.
This is a very serious matter. You should contact an attorney immediately so that
you can be prepared for the court hearing. You have the right to hire an attorney
and to have him or her represent you. If you cannot afford to hire an attorney, the
court will appoint an attorney if the court finds that you are an indigent person.
Whether or not you decide to hire an attorney, you have the right to attend the
hearings of your case, to call witnesses on your behalf, and to question those
witnesses brought on against you.
You may file in the office of the Clerk of this Court and serve upon Plaintiff’s

Springs, Georgia 30122, within (60) days of the date of the first publication, your
answer to the Department’s Petition.
Notice is hereby given that prior to a final hearing, a provisional hearing may be

163. Findings of Fact and orders of disposition made at the provisional hearing
may become final at a final hearing unless parties served by publication appear

Sealed and endorsed Bids for furnishing of all necessary materials labor, tools, equipment, and appurtenanc-
es necessary to complete the construction of the Murfreesboro Water Resource Recovery Facility (WRRF)
– Phase 4F Wet Weather Upgrades will be received by the WRRF Manager at the Laboratory Building, 2032
Blanton Drive, Murfreesboro, TN 37129 for bid delivery until 2:00 p.m. local time, on Thursday, June 20,
2024, and then at said office publicly opened and read aloud. No Bid shall be accepted after the stated date
and time.
The major work shall include furnishing all labor, material, and equipment for the installation of two (2) new
banks of ultraviolet (UV) disinfection equipment, three (3) new tertiary filters, one (1) new flow monitoring
manhole, modification of two (2) overflow weir boxes, installation of 120 LF of 60-inch ductile iron piping
purchased by Owner, and in general all appurtenances for complete and operable systems.
The Instructions to Bidders, Bid Bond Form, Bid Proposal Form, Contract Form, Performance/Payment Bond,
General Conditions, Supplementary Conditions, Drawings, and other contract documents for each contract
may be examined at the following locations
Award, if award is made, will be to the lowest responsive, responsible bidder on the lump sum bid per the
bid proposal form.

Documents, including specifications and any appendices and drawings in portable document format (pdf).
One hard copy shall be the same as electronic version, including specifications, one full-size set of drawings,
and one flash drive containing a portable document format (pdf) version of the Bidding Documents. Partial
sets of Bid Documents will not be available. Upon receipt of payment, the Engineer will transmit the elec-
tronic Bid Documents via email or other electronic means. Hard copies will be shipped via standard ground

a Bidding Documents Holder for purposes of qualifying for the Bid. Bids received from those entities not
classified as Bidding Documents Holders shall not be opened. All official notifications, addenda, and other

Holders) or mailed (hard copy Bidding Document Holders) to same person and email address and/or physi-
cal address as original electronic and/or hard copy of Bidding Documents.
In accordance with the “Instructions to Bidders,” a Mandatory Pre-Bid Conference will be held at 10:00 a.m.
local time on Tuesday, May 21, 2024, at the Water Resource Recovery Facility located at 2032 Blanton Drive,
Murfreesboro, Tennessee 37129. Attendance at said conference is a pre-requisite for submitting a bid. Bids
received from prospective bidders who did not attend this pre-bid conference shall not be opened.
NONDISCRIMINATION AND NON-CONFLICT STATEMENT: Contractor agrees that no person on the grounds
of handicap, age, race, color, religion, sex or national origin, shall be excluded from participation in, or be
denied benefits of, or be otherwise subjected to discrimination in the performance of this agreement, or in
the employment practices of Vendor. Contractor shall upon request show proof of such non-discrimination
and shall post in conspicuous places available to all employees and applicants notices of non-discrimination.
Contractor covenants that it complies with the Fair Wage and Hour Laws, the National Labor Relations Act,
and other federal and state employment laws as applicable. Contractor covenants that it does not engage
in any illegal employment practices.
Contractor covenants that it has no public or private interest and shall not acquire directly or indirectly any
interest that would conflict in any manner with the provision of its goods or performance of its services.
Contractor warrants that no part of the total contract amount provided herein shall be paid directly or indi-
rectly to any officer or employee of The City of Murfreesboro, Tennessee as wages, compensation, or gifts
in exchange for acting as officer, agent, employee, subcontractor or consultant to Contractor in connection
with any good provided or work contemplated or performed relative to the agreement.
TITLE VI OF THE 1964 CIVIL RIGHTS ACT: “Nondiscrimination in Federally Assisted Programs” – No person in
the United States shall, on the grounds of race, color, or national origin, be excluded from participation in,
be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal
financial assistance.” 42 U.S.C. section 2000 et seq.
It is the policy of the City of Murfreesboro, Tennessee Government that all its services and activities be
administered in conformance with the requirements of Title VI.
The Owner reserves the right to waive any informality or to reject any or all bids. Each bidder must deposit
with his bid, security in the amount of five percent (5%) of the amount of bid subject to the conditions
provided in the Instructions to Bidders.
In accordance with state and local laws, the name, license number, expiration date thereof, and license
classification of the contractors applying to the bid for the prime contract and for the electrical, plumbing,
heating, ventilation, and air conditioning, roofing, vertical closed loop geothermal heating and cooling, and
masonry subcontracts, as applicable, shall appear on the outside of the envelope containing the bid. Only
one (1) contractor in each classification may be listed. Prime contractor Bidders who are to perform elec-
trical, plumbing, heating, ventilation, and air conditioning, roofing, vertical closed loop geothermal heating
and cooling, and/or masonry subcontracts shall be so designated on the outside of envelope.
Any and all Bids not meeting the aforementioned criteria for Bid submittal, will be declared nonresponsive
and void, shall not be opened or considered, and will be returned to the Bidder unopened.
All Bids must be made out and submitted on the proposal form furnished for this purpose and in accordance
with the instructions in the Instructions to Bidders. No interlineations, additions, or deletions shall be made
in the proposal form by the Bidder.
No Bidder may withdraw his bid within sixty (60) days after the actual date of the opening thereof.

classifications, appraisals and assessed values of the 2024 taxable property in
Rutherford County are NOW open for inspection by interested property owners.
According to Rutherford County Assessor Rob Mitchell, these records are open
for public inspection at 319 N. Maple Street, Suite 200, Murfreesboro TN, during
normal office hours.
Property owners or their Agent (per TCA 67-5-1407) who wish to appeal and
seek adjustments in the appraisal or classification of their property may appear
before the Rutherford County Board of Equalization, which begins its hearing
June 3, 2024.

The Rutherford County Board of Equalization will meet Monday, June 3, 2024
from 9:00 a.m. until 3:30 p.m. and will continue each weekday as needed. Appeals
